This Privacy and Cookies Policy governs the processing of personal data of users, hereinafter "Users", collected in connection with the use of the website https://55mais.pt/pt/ hereinafter the "Site", by Movimento 55+ Associação, with registered office at Rua Almeida e Sousa, n.º 48, 3º esq. º, Lisboa, NIPC 514859172, hereinafter "55+", as the entity responsible for processing.

Respecting the privacy of its clients and complying with the applicable legal obligations in this area are a priority for 55+. Accordingly, 55+ guarantees the users of this Site that their privacy will be respected, adopting the necessary measures to protect their personal data.

The provision of personal data implies knowledge of the conditions set out in this Privacy and Cookies Policy.

Collection and Processing of Personal Data
Accessing and using the Site does not require the User to provide personal data.

However, the use of certain features of the Site, such as completing forms to request services from 55+, may involve the provision of personal data by the User.

55+ is responsible for the collection and processing of the personal data of Site Users, in accordance with the applicable personal data protection legislation. Such data will be processed by 55+ for the purpose of scheduling the requested service, communicating data to the Talent(s), administering the services provided and/or providing clarifications at the User's request. With the User's consent, their data may also be processed for the purpose of analysing the suggestion/idea submitted.

User Rights
In accordance with the applicable data protection legislation, your rights include:

Right of Access: the right to confirm whether your personal data are being processed by 55+ and the right to access your personal data together with certain information, including obtaining a copy of your personal data undergoing processing. This right shall not affect the rights and freedoms of third parties, in particular the intellectual property rights of 55+;
Right to Rectification: the right to obtain from 55+ the rectification of inaccurate personal data concerning you, as well as the right to have your data completed if it is incomplete;
Right to Erasure: the right to request the deletion of your data in certain cases, in particular where your personal data are no longer necessary for the purpose that motivated their collection or processing. This right shall not affect compliance with the legal data retention obligations incumbent upon 55+;
Right to Restriction of Processing: the right to request the restriction of the processing of your data in certain cases, in particular where the processing is unlawful and you object to the erasure of the data, requesting instead the restriction of their use;
Right to Data Portability: the right to receive your personal data that you have provided to 55+, in a structured, commonly used and machine-readable format, including the right to transmit such data to another data controller;
Right to Object, meaning that in certain cases (for example, where your personal data are processed for direct marketing purposes), you may object at any time, on grounds relating to your particular situation, to the processing of your data.

In accordance with the law, the User is also guaranteed the right to withdraw consent to the processing of data for the specified purposes, provided that processing is based on consent, without prejudice to the processing carried out up to that date on the basis of the previously granted consent.

Retention of Personal Data
The personal data collected will be processed in strict compliance with the applicable legislation. Personal data will be retained in accordance with their respective purposes and the applicable legal retention periods. Accordingly, data required for the invoicing of services provided by 55+ will be retained for a period of 10 years. Where no specific legal requirement exists, data will be stored and retained only for the appropriate period and to the extent necessary for the purposes for which they were collected, unless the right to object, the right to erasure or the withdrawal of consent is exercised within the legal limits.

Sharing of Personal Data
55+ may transfer your data to subcontracted entities for the purposes referred to above, in accordance with the agreements concluded with them.

User data may also be communicated to 55+ Talents and/or third parties where such transfer is carried out in compliance with a legal obligation, a decision of the National Data Protection Commission or another relevant supervisory authority, or a court order; or where the communication is made to protect the vital interests of Users or other legitimate purposes provided for by law.

Security Measures
55+ takes all possible steps to protect the personal data of Users against unauthorised access. To this end, security systems, rules and other procedures are used to ensure the protection of personal data and to prevent unauthorised access to data, misuse, disclosure, loss or destruction.

However, it is the responsibility of Users to ensure that the devices and equipment used to access the Site are adequately protected against malicious software, computer viruses and worms.

Cookies are small text files that identify the User's computer on the 55+ server. Cookies themselves do not identify the individual user, only the computer used.

55+ reserves the right to amend these personal data processing terms at any time. Such changes will be duly announced on the pages of the Site and, if they materially alter the way in which your data will be processed, 55+ will notify you of such changes through the contact details you have provided.

However, whenever significant changes relating to cookies are made affecting the User, a pop-up window will reappear so that, depending on the type of cookie in question, the User may access the information and/or give their consent to its use and storage.
